The Supreme Court of the land threw out Solicitor General Donald Verrilli’s request to back the FCC’s decision to fine broadcasters for Janet Jackson’s “wardrobe malfunction” during the 2004 Super Bowl mid-game cultural extravaganza.
The indecency rules, Verrilli argued, should be applied because they cover fleeting nudity.
It turned out that Verrilli should have picked a better nipple to protect than Janet’s. Said nipple suffered so many cosmetic reconstructions that the Justices had a hard time distinguishing the plastic from the flesh.
For the rest of us, let’s hope Verrilli does not find the time to urge the Court to uphold the Salem trials.
